Führende israelische Menschenrechtsgruppen sagen, "es habe keinen Zweck mehr", Klagen gegen Soldaten einzureichen - Allison Deger - Als der 17 Jahre alte Palästinenser Mohammed Kusba im Juli 2015 von israelischen Soldaten in der Nähe des Checkpoints von Qalandia erschossen wurde, sagte das israelische Militär, Kusba habe eine Menge Steine auf ein Armeefahrzeug geworfen.

Aber der Menschenrechtsaktivist Iyad Haddad spürte eine Aufnahme von CCTV von dem Vorfall auf, die zeigte, dass der Jugendliche einen einzigen Stein auf einen Militärjeep geworfen hatte, als dieser davonbrauste. Das Fahrzeug kam zurück, und ein Soldat erschoss ihn.

Als Feldforscher für die israelischen Menschenrechtsgruppe B'Tselem übergab Haddad die Aufnahme den Ermittlern der Armee, der Stelle, die für die Strafverfolgung von widerrechtlichen Tötungen durch Militärangehörige zuständig ist.

Die Beweisermittlung ergab sich als erfolgloser Weg. Nachdem der Kommandeur das Band gesehen hatte, habe er dem Militärermittler erzählt, der Soldat hätte schlecht gezielt, er hätte dem Palästinenser auf die Beine schiessen wollen und nicht in den Kopf, gab Haddad weiter.

Wegen diesem und ähnlichen Fällen hat B'Tselem heute erklärt, 'es habe keinen Sinn mehr', weiterhin Klagen beim israelischen Militärgerichtswesen einzureichen. Mit der Entscheidung enden 25 Jahre, in denen die Menschenrechtsorganisation Fälle vor das israelische Militärgericht gebracht und sich für Ermittlungen in Fällen von Tötungen von Palästinensern eingesetzt hat.


Die Entscheidung, die Kooperation mit der Armee zu beenden, folgt auf abgewürgte und fehlerhafte Ermittlungen in mehr als 700 Fällen seit 2000, was zu einer Verurteilungsrate von 3% führte. Die Menschenrechtsgruppe hat es tatsächlich aufgegeben, an die Fähigkeit des Systems zur Selbstkorrektur oder zur Übernahme von Verantwortung zu glauben. >>>


 

Anstand und Zivilcourage versus zynischer Opportunismus in Israels Politik - Carlo Strenger - Durch Israels politisches System ist in den letzten Wochen ein Erdbeben gegangen. Wie ich letzte Woche schon geschrieben habe, begann alles damit, dass Israels Generalstabchef und Vizegeneralstabschef öffentlich klare ethische Positionen eingenommen haben: Sie betonten, dass trotz Israels schweren Sicherheitsproblemen die israelische Gesellschaft, aber vor allem die Armee ihre moralischen Massstäbe nicht verlieren dürften. Es ging unter anderem darum, dass ein israelischer Soldat einen Palästinenser, der vorher israelische Soldaten mit einem Messer angegriffen hatte, aber schon durch einen Selbstverteidigungsschuss verletzt am Boden lag, aus nächster Nähe erschoss.

Ministerpräsident Netanjahu sowie eine Reihe rechtspopulistischer Minister nahmen sehr schnell für den Soldaten Partei, obwohl ein militärgerichtliches Verfahren gegen diesen eingeleitet worden war – eine Parteinahme, welcher der demokratischen Gewaltentrennung entgegensteht. >>>


 

B’Tselem gives up taking complaints to Israeli army for ‘whitewash mechanism’ - The leading rights group, B’Tselem announced on Wednesday it was giving up taking complaints over soldier conduct to the Israeli military, after years of going through official channels brought few prosecutions. B’Tselem, which campaigns against Israel’s military presence in the West Bank, said it had been providing information to the Military Advocate General Corps about alleged abuses for 25 years, but had concluded it was increasingly a “whitewash mechanism.” >>>

When Mohammed Kusba, a 17-year old Palestinian, was gunned down by Israeli soldiers near Qalandia checkpoint in July 2015, the Israeli military said Kusba had launched a barrage of stones at an army vehicle. But human rights worker Iyad Haddad tracked down CCTV footage of the incident, showing the youth throwing a single rock at a military Jeep as it sped off. The car returned and a soldier shot him dead.

As a field researcher for the Israeli human rights group B’Tselem, Haddad turned over the recording to army investigators, the body responsible for prosecuting forces in criminal wrongful death trials. >>>

 


Israeli human rights organization stops working with military; says “We won’t be used to whitewash” - The Israeli Information Center for Human Rights in the Occupied Territories, B’Tselem, announced Wednesday that they will stop working with the Israeli military law enforcement unit, which is supposed to handle complaints filed against soldiers for harm caused to Palestinians in the West Bank, but which, according to B’Tselem, is instead used to whitewash Israeli war crimes.

The statement by B’Tselem follows: The role of the military law enforcement system has been narrowly defined to begin with: it investigates only specific incidents in which soldiers are suspected to have acted in breach of the orders or directives they were given. The system does not investigate the orders themselves nor the responsibility of those who issue them or determine the policy. As such, the system is oriented toward low ranking soldiers only, while senior military and government officials, including the Military Advocate General (MAG), are absolved in advance of any responsibility. In this state of affairs, even if the system had fulfilled its tasks, its contribution to law enforcement would still remain limited. However, an examination of the operation of the military law enforcement system indicates that it makes no attempt to fulfill even this limited mandate.

Ever since B’Tselem was established more than 25 years ago, it has applied to the MAG Corps regarding hundreds of incidents in which Palestinians were harmed by soldiers, demanding the incidents be investigated. Some of B’Tselem’s applications led to the launching of criminal investigations. In many cases, B’Tselem assisted investigators in making arrangements for them to collect statements from Palestinian victims and eyewitnesses, and by obtaining medical records and other relevant documents. Once the investigations were concluded, B’Tselem followed up with the MAG Corps to get information as to the case outcome. In some cases, B’Tselem appealed the MAG Corps’ decision to close a case, and in a few instances, even petitioned Israel’s High Court of Justice (HCJ) against a decision to close a case, or regarding unreasonable delays in the MAG Corps’ processing of a case.

Since the second intifada began in late 2000, B’Tselem has demanded an investigation in 739 cases in which soldiers killed, injured, or beat Palestinians,used them as human shields, or damaged Palestinian property. >>>

Die israelische Armee hat auf alle und jeden geschossen,der raus oder rein wollte,sogar auf ein Auto des deutschen Vertretungsbüro.Die Armee war informiert,denn es sollten zwei Mädchen einer deutschen Mutter und eines Palästinensers mit deutschen Pass nach Ramallah geholt werden,damit sie ihr Abitur machen konnten.Die eine ist heute Ärztin und die andere Dr.der Biologie.Sie hatten es am Ende mit der Hilfe des deutschen Vertretungsbüro geschafft.Nicht alle haben haben dieses Glück.

Von was ich eigentlich schreiben möchte und was mir bis heute nicht aus meinen Kopf geht,ist ein junger Palästinenser der nicht in den Schlagzeilen der Welt erschienen ist.Er wollte, wie alle aus den abgeriegelten Dörfern raus nach Ramallah.Die israelischen Soldaten schossen auf ihm und ließen ihm neben sich verbluten.Sie aßen und tranken Kaffee dabei und ließen keinen Krankenwagen ran damit der Junge versorgt werden konnte.Es war für mich so schlimm.Ich konnte mir gar nicht vorstellen,dass Menschen zu so etwas fähig waren und dass es so gar nicht an die Öffentlichkeit kam. >>>

Im Rahmen unseres gestrigen Besuches in den palästinensischen Autonomiegebieten trafen wir in Ramallah mit dem Ministerpräsidenten Rami Hamdallah zusammen. (…) Die Linke befürwortet die Anerkennung eines Palästinenserstaats. Die aktuelle Politik der israelischen Regierung zielt dagegen auf eine Ein-Staaten-Lösung.

Ministerpräsident Hamdallah berichtete eindrücklich von den verheerenden ökonomischen und sozialen Folgen der israelischen Siedlungs- und Besatzungspolitik. (…)

Begleitet von der Büroleiterin der Rosa-Luxemburg-Stiftung, Katja Hermann, und Vertretern palästinensischer Nichtregierungsorganisationen machten wir uns in der Nähe von Ramallah ein Bild vom Mauerbau durch die israelischen Behörden. (…) Am Abend trafen wir uns dann mit Vertretern linker palästinensischer Parteien und Nichtregierungsorganisationen (…). Wir hoffen, die palästinensischen Linken bald auch im Bundestag begrüßen zu können. Denn ihre Sicht auf den Konflikt ist in der deutschen Öffentlichkeit weithin unbekannt. Es wäre sicher ein Gewinn, auch im Hinblick auf eine Änderung der Nahostpolitik der Bundesregierung, wenn sich dies ändern würde.

Hamas will 13 Menschen im Gazastreifen öffentlich hinrichten lassen - Die Männer sind wegen Mordes verurteilt. Menschenrechtler kritisieren die Ankündigung, zwischen Hamas und der rivalisierenden Fatah droht der nächste Konflikt.

Die im Gazastreifen herrschende Hamas plant eine Serie öffentlicher Hinrichtungen. Abgeordnete billigten am Mittwoch eine entsprechende Verordnung. Die 13 Männer wurden bereits wegen Mordes verurteilt. Hamas-Staatsanwalt Ismail Dschaber hatte bereits vor einigen Tagen angekündigt: "Die Todesstrafe wird bald in Gaza vollstreckt werden. Und ich bitte darum, dass man es vor einer großen Menge tut."

Der jetzt angekündigte Entschluss widerspricht in einiger Hinsicht der bisherigen Praxis: Dem Palästinensische Zentrum für Menschenrechte (PCHR) zufolge wurden seit 1994 zwar 170 Todesstrafen verhängt, allerdings "nur" 30 vollstreckt. The three minute warning….. - On Wednesday we sat with Abu Sadam in the rubble of all that remains of his family’s house, in Hisbet Wadi Joz, East Jerusalem. Early Tuesday morning at about 2am occupying forces arrived with a digger to demolish the house. The Israeli authorities have planned a national park and his home is in the way. Although the house was on Waqf land (The Jerusalem Islamic Waqf is a trust best known for controlling and managing buildings and land on and around Haram Al-Sharif), because it was built after the occupation in 1967 it is not protected.
The family were given three minutes notice to vacate the house and were not allowed to remove their furniture and belongings . Although some of the larger pieces were removed (thrown) from the house by the Israeli military, much has been broken or lost under the rubble. There are sixteen people in the family, most of them children. They are now homeless and all they have to protect them from the elements is a tarpaulin sheet .The demolition was aggressive and the occupying forces used physical violence against Abu Sadam, one of the children and internationals who were present at the time. The children are now frightened and traumatised. >>>

Israel embraces more hate - Yvonne Ridley - One of the biggest Zionist propaganda claims is that the Palestinian people hate life and use their children as human shields. Having experienced Palestine first hand from the West Bank to the Gaza Strip I can tell you that this is a wicked lie. The precious love of a mother is as evident in the poverty of the refugee camps and bombed out homes of the Palestinians as it is anywhere else in the world.

Furthermore, despite the daily injustices encountered at all levels of Palestinian life, from local to international, there has always been a surprising amount of optimism. This positive outlook on life and eternal hope has never failed to amaze me, even as someone who has always tried to look on the bright side of life, in the belief that you can achieve far more than those weighed down by negative views.

I’m not sure where the Palestinian people get their optimism from — perhaps it’s their faith — but  >>>
