Großbritannien - Offizielle' Definition von Antisemitismus wird von Rechtsexperten mit einer verächtlichen Geste abgetan

Die Feinde der freien Rede hatten eine gute Zeit ... bis zu dieser Woche. Britische politische Parteien, Bildungseinrichtungen und BDS-Gruppen wurden auf Grund einer erfundenen Definition von Antisemitismus geprügelt, damit sie zu Israels Verbrechen schweigen. Diese Definition wurde von Regierung und Polizei sowie von verschiedenen pro-israelischen Spitzeln, Handlangern (Strohmännern) und Kriechern formell übernommen und angewendet.

Ihre Einschüchterungstaktiken haben jetzt Free Speech on Israel, Independent Jewish Voices, Jews for Justice for Palestinians und die Palestine Solidarity Campaign entrüstet; sie haben Top-Rechtsexperten um ihre Meinung zu dieser üblen Farce gefragt.


Die eigentliche Ursache war eine außergewöhnlich dumme, rechtlich nicht bindende Arbeitsdefinition von Antisemitismus, die von der International Holocaust Remembrance Alliance (IHRA) wie folgt herausgegeben worden ist:


Antisemitismus ist eine bestimmte Wahrnehmung von Juden, der sich als Hass    Juden gegenüber äußern kann. Rhetorische und physische Äußerungen von    Antisemitimus sind gegen einzelne Juden oder Nicht-Juden und/oder ihr    Eigentum, gegen Institutionen der jüdischen Gemeinde oder religiöse    Einrichtungen gerichtet.



Der Sonderausschuss für innenpolitische Angelegenheiten des Unterhauses akzeptierte die Definition von IHRA, allerdings mit zwei Vorbehalten:


Es ist nicht antisemitisch die israelische Regierung zu kritisieren, wenn es keine zusätzlichen Anhaltspunkte gibt, die für eine antisemitische Intention sprechen.

. Es ist nicht antisemitisch, an die israelische Regierung dieselben Standards anzulegen wie an andere liberale Demokratien oder sich speziell für die Politik und die Aktionen der israelischen Regierung zu interessieren, wenn es keine zusätzlichen Anhaltspunkte gibt, die für eine antisemitische Intention sprechen.



Der Sonderausschuss empfahl "die formale Übernahme dieser verbesserten Definition durch die britische Regierung, durch Strafverfolgungsbehörden und alle politischen Parteien, als Hilfe bei der Feststellung, ob ein Zwischenfall oder ein Vortrag/Diskussion als antisemitisch betrachtet werden kann oder nicht".


Definition "zu vage, um hilfreich zu sein"
 - Hugh Tomlinson, ein herausragender Menschenrechtsanwalt, hat die Definition scharf kritisiert.

Erstens war es keine rechtlich bindende Definition und hatte nicht die Kraft einer gesetzlichen Definition. Auch kann sie nicht als eine juristische Definition von Antisemitismus gelten, da ihr Klarheit fehlt. Daher kann nicht jedes Verhalten, das der IHRA-Definition entspricht, als rechtswidrig erklärt werden.

Zweitens war ihre Sprache viel zu vage, um ein hilfreiches Instrument zu sein; es war für die Regierung sehr unbefriedigend eine Definition zu übernehmen, der Klarheit und Vollständigkeit fehlen. Aus Tomlinsons Sicht war die Regierungsentscheidung die IHRA-Definition zu übernehmen, einfach eine freistehende Grundsatzerklärung – ein bloßer Vorschlag für eine Definition von Antisemitismus, die öffentliche Stellen möglicherweise gerne nützen würden. Keine öffentliche Stelle wäre verpflichtet, sie zu übernehmen oder zu benützen bzw. sollte sie wegen ihrem unbefriedigendem Charakter zurückgewiesen werden. 


Er mahnte, wenn eine öffentliche Stelle sich entschieden hat die Definition zu übernehmen, dann muss sie sie so interpretieren, dass sie mit den gesetzlichen Verpflichtungen vereinbar ist. Insbesondere können sich öffentliche Stellen nicht auf eine Art verhalten, die nicht mit der Europäischen Menschenrechtskonvention vereinbar ist, die die Freiheit der Meinungsäußerung und die Versammlungsfreiheit bestimmt.


Freiheit der Meinungsäußerung gilt nicht nur für Information oder Ideen, die als positiv wahrgenommen oder als harmlos betrachtet werden, sondern auch für die, die "den Staat oder einen Teil der Bevölkerung verletzen, schockieren oder beunruhigen". Außer natürlich, sie laufen auf einen Aufruf zu Gewalt oder eine Rechtfertigung von Gewalt, Hass oder Intoleranz hinaus.


Eine weitere Pflicht öffentlicher Stellen ist es, "förderliche Bedingungen für die Teilnahme an öffentlichen Debatten für alle Beteiligten zu schaffen, die ihnen erlauben, ihre Meinungen und Ideen ohne Angst zu äußern, sogar wenn diese Meinungen und Ideen im Gegensatz zu denen stehen, die die offiziellen Stellen oder ein großer Teil der öffentlichen Meinung vertreten, oder sogar wenn diese Meinungen und Ideen die Öffentlichkeit irritieren oder verletzen".

Demnach bedeutet nach Tomlinsons Meinung die IHRA-Definition nicht, dass es regelrecht als antisemitisch bezeichnet werden kann, wenn Israel ein Apartheid-Staat genannt wird, der Siedlerkolonialismus praktiziert, oder wenn Boykott, Desinvestition und Sanktionen (BDS) gegen Israel befürwortet wird. Darüber hinaus würde eine öffentliche Stelle, die versucht, die IHRA-Definition anzuwenden, um solche Aktivitäten zu verbieten oder zu bestrafen "rechtswidrig handeln".


Die 'naive Haltung' der Regierung
- Der Berufungsrichter Sir Stephen Sedley schaltete sich mit einer Ermahnung ein, indem er die IHRA-Arbeitsdefinition wegen ihrer fehlenden Rechtskraft scharf kritisierte: "Dabei ist sie nicht neutral: sie kann sowohl die Innen- wie die internationale Politik beeinflussen."


Er fügte hinzu, dass das Recht auf freie Meinungsäußerung, das heute Teil unseres innerstaatlichen Rechts kraft seines Human Rights Acts ist, "dem Staat positive und negative Pflichten auferlegt, die gefährdet sein können, wenn man der IHRA-Definition gedankenlos folgt". April 2017 - Sehr geehrter  Herr Minister Gabriel, als mein Mann und ich vor mehr als zehn Jahren einen Termin im Auswärtigen Amt wahrnahmen, wurden wir mit dem Satz empfangen: „Wir machen uns große Sorgen um den wachsenden Antisemitismus.“ Wir antworteten, dass das Ende der israelischen Besatzung der Gefahr des Antisemitismus Einhalt gebieten könne.

Es ist richtig, die fortgesetzte Siedlungspolitik zu verurteilen – wie Sie es am 31. März 2017 erneut getan haben. Doch die Rhetorik allein reicht nicht aus, solange ihr keine politischen Konsequenzen folgen. Dies hat dazu geführt, dass die von der internationalen Diplomatie beschworene Zwei-Staaten-Lösung immer unrealistischer wird.

Mit Recht verurteilen wir die Menschenrechtsverletzungen in Ländern wie der Türkei und Russland. Zu fünfzig Jahren Unterdrückung, Erniedrigung und Freiheitsberaubung der palästinensischen Bevölkerung aber schweigen wir.

Ein immer größerer Teil der deutschen Öffentlichkeit positioniert sich gegen die israelische Regierung und ihre Unterstützer. Jüdische Gemeinden, die jede Kritik an der israelischen Politik als „Antisemitismus“ abtun sowie Institutionen, die thematisch kritische Veranstaltungen verbieten, werden als Komplizen der israelischen Regierung wahrgenommen. Das Einknicken deutscher Institutionen wie unlängst in Berlin, Hamburg, Göttingen und Frankfurt (und derzeit in München, wo der Vortrag eines der bekanntesten israelischen Journalisten - der täglich in Israel publiziert - verboten werden soll), wird als Angriff auf die eigene Meinungsfreiheit verstanden und schürt noch eher den Antisemitismus. Das Klima ist mittlerweile so vergiftet und die Fronten dermaßen verhärtet, dass ich die große Befürchtung habe, dass eines Tages dies auf uns alle Jüdinnen und Juden zurückschlagen wird.

Die Bewegung „Boykott, Entzug von Investitionen, Sanktionen“ (BDS) würde sich erübrigen, wenn die europäische und deutsche Israel-Politik auf die Alternative drängte – nämlich auf das Ende der Besatzung und die Gleichstellung der palästinensischen Bevölkerung in Israel und Palästina. Erst dann hat die Zwei-Staaten-Lösung noch eine Chance. Israel wird in Ihrer Pressemitteilung die unverbrüchliche Freundschaft zugesichert, obwohl mittlerweile die politische Verfolgung auch jüdische Dissidenten trifft. The European Union’s Legal Obligation to Stop Trade with Illegal Israeli Settlements Hits the Mainstream - 10. 3. 2017 -  Last week, one of the most prominent legal journals in the world, The European Journal of International Law, published an article on its website affirming that the European Union and its member states have a legal obligation to stop all trade with illegal Israeli settlements built on stolen Palestinian land. This indicates that opposition to trade with Israeli settlements is growing and becoming increasingly mainstream.

As the EJIL article explains, Israel’s ongoing construction of illegal settlements on Palestinian land violates cardinal rules of international law like prohibit seizing of territory by force, forbid apartheid and population transfer as well as the right to self-determination. Under the Rome Statute of the International Criminal Court Israeli settlement construction may amount to war crimes.

The legal conclusion that trade with Israeli settlements violates international law is supported by a vast community of international lawyers, including two former UN Special Rapporteurs, ad hoc judges to the International Court of Justice, a former president and members of the International Law Commission (the key UN body concerned with the development of international law).

In the last few years, this vast legal community has refined its arguments and published an open letter calling on the EU and its Member States to comply with their international legal obligation to withhold from trading with Israeli settlements.

Tom Moerenhout, author of the article published by the European Journal of International Law and initiator of the open letter from legal experts to EU decision makers, said “Stopping trade with illegal Israeli settlements is not just an option to consider, but a legal obligation.”

In 2013, public pressure and lobbying by Palestinian and European organizations led the EU to introduce a policy against providing funding for or allowing Israeli participation in EU projects, if such projects or participation effectively recognizes Israeli sovereignty over occupied Palestinian and Syrian territory. >>>

PLO denounces Israel for deporting Chilean BDS activist -  PLO Executive Committee Member Hanan Ashrawi denounced the state of Israel for deporting head of the Palestinian Federation of Chile Anwar Makhlouf, who is well known for his activism in the Boycott Divestment and Sanctions (BDS) movement.

“The deportation of Mr. Makhlouf, who is committed to BDS, a legitimate form of nonviolent and peaceful resistance, is a blatant and crude exercise of power and a form of political siege,” Ashrawi wrote in a written statement Tuesday, a day after Makhlouf was denied entry through the Allenby Bridge border crossing between Jordan and the occupied West Bank.

According to Ashrawi, Makhlouf “was leading an annual delegation to familiarize Chileans of Palestinian descent with Palestine, and to celebrate Easter in the Holy Land,” when Israeli authorities decided to deport him. >>>

Gegen Russland: EU favorisiert neue Erdgas-Pipeline aus Israel (DWN) - Die EU-Kommission, Israel und drei weitere EU-Staaten haben sich für den Bau einer Erdgas-Pipeline ausgesprochen. Diese wird bewusst als Alternative zur russisch-deutschen Nord Stream 2-Pipeline in der Ostsee ins Gespräch gebracht. Die EU hat überraschend erklärt, dass sie das Projekt „East Med“ für das für die EU am besten geeignete hält. Damit schwinden die Chancen auf Nord Stream 2, das in der EU nur von Deutschland und Österreich gewollt wird.

Die EU-Kommission und Israel sowie die drei EU-Staaten Italien, Griechenland und Zypern haben sich für den Bau der Pipeline ausgesprochen, um Erdgas nach Europa zu bringen, berichtet der EUObserver. Zu diesem Zweck haben Vertreter der betroffenen Unternehmen und Regierungen am vergangenen Montag eine Vereinbarung in Tel Aviv unterzeichnet. Die Planungen sehen vor, Gas aus israelischen und zypriotischen Feldern im Mittelmeer nach Griechenland und Italien zu bringen. Dazu soll im Mittelmeer eine Pipeline gebaut werden, die nicht durch türkische Gewässer verläuft, um mögliche politische Auseinandersetzungen zu vermeiden. Der israelische Energieminister Yuval Steinitz sagte bei der Vorstellung des Projekts in Tel Aviv, dass die Pipeline bei 2025 fertiggestellt sein solle, wenn möglich sogar schneller.

Die 2.200 Kilometer lange „East Med“-Pipeline soll im Jahr 2025 betriebsbereit sein und eine jährliche Kapazität von 16 Milliarden Kubikmetern Erdgas haben. Eine von der EU mitfinanzierte Studie der italienisch-griechisch-bulgarischen Firma IGI Poseidon sprach sich kürzlich für das Projekt aus. Die Firma ist führend an dem Projekt beteiligt. Die Geografie erklärt das aktuelle geopolitische Interesse an Nordafrika: Die Grafiken der im Energiegeschäft tätigen Investment-Firma Pytheas zeigen, dass nördlich von Libyen und Ägypten Gas- und Ölvorkommen ausgebeutet werden könnten, die dann mit der „East Med“ in die EU gebracht würden. In Libyen kämpfen Russen und Amerikaner um die Vorherrschaft, um die Kontrolle über das Öl und Gas im Land zu erringen. It fully took off at the American Israel Public Affairs Committee (AIPAC) conference in March, 2016. Since, Donald Trump has proven his loyalty to right-wing Zionists by supporting the expansion of Israeli settlements and the annexation of parts of the West Bank, prioritizing the controversial move of the American embassy from Tel Aviv to Jerusalem, announcing the death of the two-state solution during Israeli Prime Minister Benjamin Netanyahu’s visit to the White House and appointing his bankruptcy lawyer David Friedman as ambassador to Israel. Only recently, Nikki Haley received a “rockstar welcome” at the annual 2017 AIPAC meeting when she promised to treat what the Israeli government and its allies view as an inherent bias against Israel at the UN.

Trump’s April 6th strike on Assad forces was yet another advance in his longstanding bromance with Netanyahu. In Israel the strikes were met with resounding approval and even applause; nothing reassures Israelis more than an American show of force in the “rough neighborhood of the Middle East”. The last time a bombing was met with such glee in Israel was during Operation Protective Edge in 2014, when residents of Sderot gathered on hilltops opposite Gaza to watch its bombardment by the Israeli Defense Force (IDF).

‘This miracle, this gift, this jewel’ — Obama’s ambassador to Israel declares he’s a Zionist - Philip Weiss - 10. 4. 2017 - Two weeks ago in Washington, Hanan Ashrawi told a crammed hall at the National Press Club something I did not know before, that Obama’s ambassador to Israel, Daniel Shapiro, was now an expert at a quasi-official Israeli security thinktank. Speaking with bitter disdain, the longtime Palestinian negotiator described Shapiro as part of the “revolving door” of Israel lobbyists inside and outside government, who have made sure the US participation in the peace process was biased toward Israel:

They don’t need to lobby; they are decision makers… You’d be surprised that…ex-ambassador Daniel Shapiro, for example, decided to stay in Israel, has joined the Institute for National Security Studies. Which is something that also Dennis joined at one point or another– Dennis Ross. So it’s interchangeable. Either they are influencing policy or they are making policy.

And that’s why American policy was so distorted, because they played a significant role in framing and defining the discourse and perceptions but went beyond that to manipulating the verbal public space, anything related to the peace process. And they generated a narrative based on myths and provided alternative facts. It’s not Kelly Anne who invented alternative facts. We’ve been victims of alternative facts all our lives, they’ve certainly willfully misled public opinion.

As luck would have it, a few days after Ashrawi spoke, Shapiro appeared at the Park Avenue Synagogue in New York on a panel on the “Future of Zionism,” and I paid $25 for the privilege of hearing him. He repeatedly described himself as a Zionist that night: >>>
